Markado Terms of Service
By accessing or using the Markado app or website ("MARKADO"), you agree to these Terms.
1. Platform Overview
Markado operates as an online marketplace that facilitates transactions between independent sellers and buyers.
Unless explicitly stated otherwise, Markado does not own, manufacture, or directly sell products listed by third-party sellers.
2. Eligibility
To use Markado, you must:
Be at least 18 years old or have the legal capacity to enter into binding agreements under applicable law.
Comply with all applicable Swiss laws and regulations.
Provide accurate and complete information when creating an account.
Markado may suspend or terminate accounts that violate these Terms.
3. User Accounts
Users are responsible for:
Maintaining the confidentiality of their account credentials.
Providing accurate, current, and complete information.
All activities conducted under their account.
Markado reserves the right to verify user identities where required by law or for fraud prevention purposes.
4. Seller Obligations
Sellers agree to:
List only authentic and legally permitted products.
Provide accurate descriptions, pricing, and images of listed items.
Fulfill and ship orders within the stated timeframes.
Comply with applicable Swiss consumer protection laws, competition laws, intellectual property laws, and other relevant regulations.
The sale of counterfeit, replica, stolen, or otherwise unlawful goods is strictly prohibited.
Markado reserves the right to remove listings, withhold payments, or suspend seller accounts for violations of these Terms.
5. Payments and Fees
Payments are processed through secure third-party payment service providers.
Markado may:
Charge service, transaction, or commission fees.
Withhold payouts while investigating disputes, fraud, or policy violations.
Issue refunds where appropriate under these Terms.
Markado does not store complete payment card information and relies on certified payment providers for payment processing.
6. Buyer Protection
Markado may offer Buyer Protection for eligible transactions.
Refunds or other remedies may be available if:
An item is materially different from its description.
An item is determined to be counterfeit or unauthorized.
A seller fails to ship the item within the promised timeframe.
Buyer Protection decisions are made by Markado in its reasonable discretion based on the information available.
7. Prohibited Conduct
Users may not:
List or sell counterfeit, illegal, or prohibited goods.
Infringe intellectual property rights.
Engage in fraud, payment abuse, or chargeback abuse.
Use the platform for unlawful, deceptive, or harmful purposes.
Circumvent Markado’s fees, policies, or security measures.
Violations may result in account suspension, termination, removal of listings, withholding of funds, and legal action where appropriate.
8. Limitation of Liability
To the fullest extent permitted by applicable Swiss law, Markado shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of the platform.
Markado’s total liability relating to any claim shall not exceed the amount paid in connection with the transaction giving rise to the dispute, except where mandatory law provides otherwise.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict-of-law principles.
Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Switzerland, unless mandatory consumer protection laws provide otherwise.
